Nevada Small Estate Affidavit Preparation Without Opening Probate
Lake Mead Mobile Notary prepares client-directed Nevada Affidavits of Entitlement for qualifying customers seeking to collect personal property from a small estate without opening a standard probate case.
The Affidavit of Entitlement may allow an eligible successor to present a notarized affidavit directly to a bank, agency, business, transfer agent, or other organization holding the deceased person’s property. The standard affidavit procedure does not require the affidavit itself to be filed with a court.
This service uses the customer’s supplied information about the deceased person, estate assets, family relationships, will, beneficiary rights, notices, and organizations holding the property. Lake Mead Mobile Notary does not decide who legally inherits the estate or whether one person has priority over another.
Who This Service May Be For
This service may be appropriate for a person who:
- Is the surviving spouse
- Is named as a beneficiary in the deceased person’s will
- Is entitled to succeed to the property under Nevada law
- Has identified the personal property to be collected
- Knows the approximate value of the entire estate
- Can identify the organization or person holding each asset
- Has confirmed that the estate contains no real property
- Can provide the required death certificate
- Has waited the legally required period after the death
- Has identified any person with an equal or higher inheritance priority
Eligibility must be reviewed before the service is accepted.
What the Starting Service May Include
The confirmed standard preparation scope may include:

Notarization, death-certificate retrieval, asset searches, heirship determinations, court petitions, certified copies, and delivery to financial institutions are separate unless expressly included.
Information the Customer Should Provide
Before preparation begins, provide:
- The deceased person’s full legal name
- Any prior or alternate names
- Date of death
- County and state of residence at death
- County and state where the death occurred
- A certified or otherwise acceptable copy of the death certificate
- A copy of the will, when one exists
- The claimant’s full legal name, address, and relationship to the deceased person
- Names and relationships of known heirs and beneficiaries
- Information about anyone with equal or higher inheritance priority
- A complete list of the estate’s assets
- The approximate value of each asset
- Information about vehicles registered to the deceased person
- Bank names, account types, and available account information
- Stock, bond, brokerage, refund, wage, or other property information
- The name of each organization holding property
- Information about debts, liens, claims, or pending lawsuits
- Confirmation concerning real property or mortgages
- Information about any pending or completed probate proceeding
- Copies of any prior notices sent to heirs
- The requested completion date
The customer must disclose the complete estate—not only the single asset currently being requested.
How the Service Works
1. Submit the estate intake
The customer provides the death certificate, claimant relationship, will, known heirs, complete asset list, approximate estate value, and information about the organizations holding the property.
2. Eligibility and scope review
Lake Mead Mobile Notary reviews the information for the standard affidavit requirements, including the waiting period, asset limits, absence of real property, claimant priority, required notices, and pending probate activity.
3. Affidavit preparation
The Affidavit of Entitlement and any accepted routine notice materials are prepared using the facts, assets, relationships, and representations supplied by the customer.
4. Customer review and notarization
The customer reviews every factual statement before signing. The affidavit must be signed through a separately confirmed notarial process, and the required death-certificate copy is attached.
5. Presentation to the asset holder
The completed affidavit is presented to the bank, agency, business, transfer agent, or other organization holding the listed property. Presentation, courier delivery, tracked mailing, or follow-up coordination is separate unless included in the confirmed order.
Before You Start
Nevada Small Estate Affidavit Eligibility
Nevada’s current self-help guidance identifies the following standard conditions for an Affidavit of Entitlement:
- At least 40 days have passed since the death
- The claimant is the surviving spouse or has the right to succeed to the property through a will or Nevada law
- The estate contains no real property, including land, houses, or timeshares
- The estate does not include a mortgage interest requiring a different process
- The claimant knows all assets belonging to the estate
- The relevant estate value is less than $25,000 for a claimant other than a surviving spouse
- The relevant estate value is less than $150,000 when the claimant is the surviving spouse
- Motor vehicles registered to the deceased person are excluded from the stated value calculation
- No petition appointing a personal representative is pending or has been granted
- The claimant has no knowledge of an existing personal-injury claim or tort-damage claim against the deceased person
These conditions must be reviewed using the customer’s complete estate information. Lake Mead Mobile Notary cannot advise a customer to omit property or classify an asset in a way intended to meet the statutory limit.
No Real Property
The standard Affidavit of Entitlement procedure is not intended for an estate containing real property.
Real property may include:
- A house
- Land
- A condominium
- A timeshare
- An ownership interest in real estate
- Property located in Nevada or another jurisdiction
A different probate or transfer procedure may be required when real property is involved. Lake Mead Mobile Notary cannot determine which court procedure should replace the affidavit when the estate does not qualify.
Claimant and Heir Priority
An affidavit cannot be prepared solely because a person is related to the deceased person.
The claimant must have a right to receive the property under:
- A valid will
- Nevada intestate-succession law
- The claimant’s status as a surviving spouse
- Another legally recognized succession right
Nevada’s self-help guidance states that when someone with a higher inheritance priority exists, the claimant must provide notice of the intended affidavit and listed property at least 14 days before signing.
Additional review or attorney assistance may be appropriate when:
- Family members disagree
- The will is disputed
- Multiple people claim the same asset
- The claimant’s priority is uncertain
- A beneficiary died after the deceased person
- A person may have been omitted
- Parentage or marital status is uncertain
- The estate involves a trust
- The deceased person lived outside Nevada
- Another state’s succession law may apply
Lake Mead Mobile Notary does not determine heirs, interpret disputed wills, or resolve competing inheritance claims.
The Affidavit Is Presented to the Asset Holder
The standard affidavit is generally presented directly to the organization holding the property rather than filed as a new probate case.
The organization may have its own requirements concerning:
- Certified death certificates
- Original notarized affidavits
- Institution-specific forms
- Signature guarantees
- Tax identification
- Account documentation
- Medallion guarantees
- Certified copies
- Internal review periods
- Court orders
Preparation of the affidavit does not guarantee that a particular bank, transfer agent, agency, brokerage, insurer, employer, or other organization will accept it.
When a Direct-Transfer Court Petition May Be Needed
When an organization will not transfer an eligible asset based on the affidavit alone, Nevada provides a separate petition process through which a person may ask the district court for an order directing the transfer.
The direct-transfer petition is a separate court service. It ordinarily involves a court cover sheet, request for submission, petition, filing fee, judicial review, and potentially a certified copy of the resulting order.
This starting affidavit service does not include preparation or filing of that petition.
Signing and Notarization
The Affidavit of Entitlement must not be signed until the claimant is in the presence of the notary performing the notarization.
The signer must personally confirm that the affidavit’s factual representations are true. A false affidavit may create serious civil or criminal consequences.
Notarization confirms the identity of the signer and completion of the notarial act. It does not establish that the signer is legally entitled to the assets or that every statement in the affidavit is correct.

Transfer and Acceptance Are Not Guaranteed
Lake Mead Mobile Notary does not guarantee:
- That the estate qualifies for the affidavit procedure
- That the claimant has the highest inheritance priority
- That every estate asset has been identified
- That the will is legally valid
- That an institution will accept the affidavit
- That an asset will be released
- That a dispute will not arise
- That a court petition will not later be required
